SB 612 requires labor brokers in construction to be licensed, but specifically exempts traditional construction contractors from this licensing requirement. (Of course, under existing law, those contractors still would need a CCB license). Anyone who files building permits, provides supplies or heavy equipment or has a direct relationship with an owner is exempt from licensing under this statute. See Section 1 of the bill creating ORS 658.405(2)(b)(A). By definition, then, any owner could not be liable for damages for using an unlicensed labor broker, since anyone with whom the owner contracted would be exempt from licensing under this bill.
