I was laid off due to the COVID-19 Pandemic. I applied for Unemployment Insurance and was granted benefits. During quarantine, I discovered my employer was withholding wages, not paying overtime, not paying Oregon Sick Pay…in addition to several other problems. Three months into the Stay At Home Order, and past the date my employer claimed my job would reopen, I discovered that my job had opened back up for business, but did not inform me about returning to work. After three weeks past the proposed reopen date, I assumed I was not invited back to work. I then sought legal representation in order to collect wages that I believe are owed to me. My legal representation stated that I need to send a Wage Dispute Letter and officially terminate my employment at my job to start the process of litigation. Here is my question – What is the appropriate answer to the weekly question regarding “did I quit a job last week” when I believe I was not offered worked for what ever reason, BUT I had to officially quit my job for legal pursuit purposes. I don’t want to answer incorrectly or be accused of committing fraud, but I don’t and can’t afford to loose my UIB.

If you can offer advice, I would greatly appreciate it.

I’d like know your opinion on a matter of mine. I fired my guy because he refused to work past 5 p.m. without notice. He didn’t have a full 40 hrs for the week so, there was no overtime. We also offered him his job back a day or to later. He just wants to collect UI. I would very much like to see him denied those benefits. Not right, never asked him to work overtime before and needed a windshield done that night. Plz advise how I might be prepared to my best ability in fighting this case.
