An attorney representing two Lake Oswego groups has filed with the Oregon Land Use Board of Appeals a notice of intent to appeal city approval for a proposed downtown development.

Gregory Hathaway, an attorney with Portland-based Hathaway Koback Connors LLP, on Oct. 24 filed an appeal on behalf of the Evergreen Neighborhood Association and Save Our Village asking that LUBA overturn the Lake Oswego City Council‘s decision to allow construction of a sizable mixed-use development. It would include 201 residential units, six live-work units and 36,000 square feet of commercial space in three separate buildings on 2.5 acres at 140 A Ave.

The $92 million Wizer project is being proposed by Eugene Wizer and Portland-based development firm Evergreen Group LLC.

Lake Oswego’s Development Review Commission in August denied approval for the project, stating that it didn’t meet 1988 Urban Design Plan standards for the city. The developers appealed to the city council, which in September heard public testimony and on Oct. 7 issued its findings and overturned the commission’s denial.

According to the appeal filed with LUBA, the groups opposing the development argue that the plan doesn’t comply with the section of the city code that calls for construction to create a 鈥渧illage character鈥� that 鈥渕eans a community of small-scale structures that appears and operates like a traditional small town 鈥� creates a sense of community and attracts people to the downtown in the same manner and using similar design concepts as historic small towns and neighborhood centers.鈥�

The appellants argue that the high-density multifamily portion proposed by the developer does not comply with this section of the code.

A date for a hearing has not yet been set by LUBA.
